I m defendant in a civil suit for partition, which has been filed by the plaintiff on the only and only basis of settlement between the family members, but the same had not been held, on the an application under order 7 rule 11 CPC has been filed that the same petition may be dismissed as there is on cause of action but civil judge has dismissed the application as Civil Judge has not appreciated material facts that plaintiff had accepted in his cross examination that there is no settlement between the family members. However, now defendant has ready to file an appeal to the senior court. now defendant can made the defendants in the appeal as proforma defendants or not
